The Terms of Use constitute a legal agreement between you and EdgeTrends. The purpose of these Terms of Use is to set forth the terms and conditions under which you will use our services.

The access and use of the contents and services of this web site confers the condition of user, accepting the present conditions and committing to use such contents and services with respect to the Law and good faith.

The reproduction, distribution or modification of any content included in this website (including but not limited to text, information, documents, drawings, designs, graphics, images, or sound or other files) without the express permission of EdgeTrends is prohibited.

CHANGES AND CANCELLATIONS OF TERMS OF USE

This Agreement shall enter into force on the day EdgeTrends notifies the Customer of the acceptance of the request for Services, or from the day EdgeTrends proceeds with the activation of the contracted Service, with its duration being understood to be indefinite. We reserve the right to modify any of the terms of this Agreement by publishing the new Terms of Use on our website and/or by sending an email to the email address provided by the user, so that they can be known by the users before processing the request for the contracting of the Services offered.

EdgeTrends may terminate this Agreement at any time for any reason by giving notice to the other party. We may suspend the services we provide to you at any time, with or without cause.

Once your user and account have been cancelled, your templates or e-mails may be deleted, as well as your data and any files or data related to your account.

Customer may terminate this Agreement by giving written notice at least thirty (30) days prior to the date on which it wishes to terminate the relationship

EdgeTrends may withdraw or suspend at any time and without prior notice the provision of the contracted Services in the event that:

• Considered in breach of any of the terms set forth in this Agreement, and may request payment of damages that may be incurred as a result of its breach.
• Has actual knowledge that the Customer's use of the contracted Services is unlawful or injures property or rights of a third party liable for compensation.
• Receive a notice informing you that the Customer's use of the contracted Services may constitute criminal activity under the laws of the country of origin of the sender of the notice, whether or not it constitutes a crime under the law.
• At the time the Customer communicates the resolution, EdgeTrends will issue the invoice for the resulting amount.

Likewise, the Agreement shall terminate upon the occurrence of any of the following causes:

• Mutual agreement of the Parties.
• Serious breach by either Party of any of its obligations under the Agreement.
• When either Party initiates liquidation, bankruptcy or suspension of payments proceedings, or its assets are seized, in such a way that the other Contracting Party runs an imminent risk of seeing the object of this Agreement frustrated.

ACCOUNT AND PASSWORD

You are responsible for maintaining the confidentiality of your user name and the password provided for it and therefore responsible for the uses made of your account, both by you and by third parties. In addition, you agree to immediately notify us of any unauthorized use of your accounts.

EdgeTrends will not make any use of the data that is part of your account beyond what is necessary to provide and improve the service it offers. User data will not be shared with any third party or used to send information.

PRICES AND MEANS OF PAYMENT

All our services are quoted in US dollars.

PRICES AND LIQUIDATION

With respect to the prices of the services, the customer will be charged the prices established in the corresponding section, as offered on the website. Prices include value added tax as provided by applicable laws in the United Mexican States (16%).

In addition to the purchase price, customer shall be responsible for all taxes, including value added, excise, use, privilege, ad valorem, customs and any other similar taxes, levies, fees or charges, imposed or increased by virtue of any municipal, state, federal, international or any other nation's law, rule, ordinance or regulation with respect to the services sold to customer. In the event Seller shall, for any cause whatsoever, become obligated to pay such taxes, Buyer shall, upon request, immediately reimburse Seller for such amounts. Customer shall provide, upon Seller's request, any tax exemption certificate.

In addition, to the extent required by applicable laws in each country, customers agree to send us duly completed tax forms to enable us to make all required filings with the tax authorities.

PRICE CHANGE

We may change prices and/or introduce new charges in addition to the prices at our sole discretion with thirty (30) days prior written notice to the User.

Notwithstanding the foregoing, we may increase prices, immediately and with contemporaneous notice.

PAYMENT

The price of the services will be paid in advance by credit card or other payment method accepted on the website.

PAYMENT TERMS

To provide any service, it will be necessary to cover 100% of the amount including taxes.

PAYMENT METHODS

Payments can be made via credit or debit card accepted.

We are not responsible for delays in our services in cases of fortuitous or force majeure. Under no circumstances will EdgeTrends pay penalties for the delay in the delivery of our services.

PROPRIETARY RIGHTS

They are owned by EdgeTrends and are protected by law, all intellectual property rights in any content of this website. We own all proprietary rights to the website as well as the software used to provide the services, except for the intellectual property rights in your submissions and lists which are owned by you.

You represent and warrant to us that you will not add or upload content to the Site to create an electronic newsletter, or for any other purpose, unless you own all proprietary rights in the content (or possess a valid license from the owner of the property rights to such content).

GENERAL RULES

While using the services of EdgeTrends the user may not:

• Disseminate or transmit illegal, abusive, defamatory, racist, offensive information, or any other type of information subject to objection, whether through photographs, texts, advertising banners or links to external pages.
• Publish, transmit, reproduce, distribute, or exploit any information or software that contains viruses or any other harmful component.
• Publish, transmit, reproduce, distribute, or exploit software or other material that is not original (pirated).
• Publish, transmit, reproduce, distribute, or exploit material that may infringe intellectual property rights.
• Publish sites that aim to illegally obtain passwords to email accounts or bank accounts.
• Post or make available material or resources about hacking, cracking, or any other information that may be considered inappropriate.
• Publish, transmit, reproduce, distribute, or exploit material containing child pornography or any related marketing.
• Create multiple free accounts for common use.

Any use of the service for illegal purposes will authorize EdgeTrends to suspend the contracted services without prior notice.

Likewise, it undertakes to:

• Not to post or send any material with defamatory, obscene, indecent, threatening, racist, abusive, or misleading content.
• You will not share your password.
• You will not incorporate into your emails text, photos, graphics, or other content that is not created by you, unless you have the appropriate licenses.
• You will not use the platform to send Spam.
• The platform will not be used to send phishing emails or any other illegal activity. In case of illegal practices, EdgeTrends reserves the right to withdraw a payment from the customer's credit card as compensation for damages that may be suffered by the reputation of its shipping machines caused by this misuse.

EdgeTrends reserves the right to stop any submission in which a high number of complaints is detected and/or that presents a high percentage of non-existent email addresses. As well as any shipment that violates any of the conditions cited in this document. These shipments stopped for non-compliance will be counted as fully sent, both in free and paid rates.

If you do not want EdgeTrends to use your logo in the customer section of your website, you must notify the EdgeTrends marketing department at any time.

GUARANTEES

The material on this website and the services (including all content, software, functions, services, materials, and information presented or accessible through it) are provided as is, without warranties of any kind, either express or implied. The Client acknowledges that the entry into force of this Agreement does not imply any type of representation, delegation, guarantee or other provisions other than those expressly described for each of the Services offered.

LIMITATION OF LIABILITY

Under no circumstances shall we or any of our employees or representatives be liable for any indirect, punitive, special, or consequential damages, even if we or any of our employees or representatives have been advised of the possibility of such damage. You agree to indemnify any employee of this company for losses resulting from any claim not authorized by this Agreement, including claims of third parties.

DISCLAIMER

We are not responsible for the behavior of advertisers, linked websites, or other users.

FORCE MAJEURE

EdgeTrends will not be responsible for delays or failures that occur in the operation of its technological architecture, as well as for interruptions or malfunctions of the contracted Services, when they have their origin in breakdowns caused by natural catastrophes such as earthquakes, floods, lightning or fires, situations of force majeure or is beyond its reasonable control.

DIVISIBILITY

The unenforceability or invalidity of any term, provision, section, or subsection of this Agreement shall not affect the validity or enforceability of the remaining terms.

MODIFICATIONS

No amendment or other change to this Agreement shall be effective unless and until the revised Agreement is posted on this Site.
